The dangers surrounding texting and driving are staggering. According to the most recent study from the Federal Communications Commission (FCC), at any given moment of the day across the country, 660,000 drivers are using their cellphones or electronic devices while driving. In just one year 3,179 people were killed and another 431,000 wounded by distracted drivers. And if that isn't bad enough, 18 percent of all crashes involving an injury and 16 percent of motor vehicle crashes that were reported to the police had distracted drivers involved.
As these numbers continue to increase, some are wondering who should be blamed? The distracted driver? Or perhaps the companies who create this technology should share in some of the responsibility.
Should Apple And Other Smartphone Companies Be Held Liable?
Recently in Texas, the question was raised as to whether or not Apple or any other smartphone or wireless company should take responsibility for preventing their devices from being used in illegal or dangerous ways such as texting while driving. According to a recent article in the New York Times, the families of the victims of a 2013 Texas crash involving a distracted driver have filed a product liability lawsuit against Apple.
The suit against Apple claims that the company knew its phones would be used for texting, but has done nothing to prevent dangerous texting. And while it is likely that the case will be dismissed on grounds that the lawyers cannot prove that use of the iPhone was the ultimate cause of this fatal accident, this case does raise some questions about product liability. There is technology out there available to block drivers from the ability to text, but at this point, the large cellphone companies are hesitant to utilize it.
